- November 8, 2011 – Siden & Associates, P.C., through Attorney Ryan C. Siden, along with Evan Fray-Witzer, Esq. of Ciampa Fray-Witzer, LLP of Boston, MA prevailed for a client facing a disproportionate request for attorneys fees. After a 5 day trial in April 2011, a jury returned only a verdict of $7,650.00 against the defendant that was facing a potential $800,000 employment discrimination claim. After the trial, plaintiff petitioned the U.S. District Court for the District of Massachusetts (USDC Mass.) for the entirety of the legal fees she had incurred during her litigation. Siden & Associates, P.C., along with Ciampa Fray-Witzer, LLP, opposed this request, arguing that none of the fees were merited due to the weakness of plaintiff’s claims and the fact that she refused a reasonable $75,000 offer prior to the trial commencing. The USDC Mass. (Young, D.J.) agreed with Siden & Associates, P.C. argument and crafted an opinion that featured Attorney Siden and the firm in Massachusetts Lawyers Weekly. - October 27, 2011 – Siden & Associates, P.C. prevails for wrongfully sued hair stylist in bogus breach of non-competition litigation. In April 2005, Siden & Associates, P.C. entered an appearance defending Michelle Connolly, a "22 year-old" hair stylist at a Quincy, MA hair salon. The owner of the hair salon sued Ms. Connolly claiming she had violated a non-compete agreement, among other claims. The hair salon owner also sued the former owner of the hair salon claiming breach of contract resulting from the sale. Siden & Associates, P.C. fought for the next four years for Ms. Connolly in a vigorously contested litigation. After a bench trial in the Norfolk Superior Court in November 2009, the Court awarded Ms. Connolly approximately $219,000.00 in damages. Siden & Associates, P.C., through Attorney Ryan C. Siden, had effectively argued that Ms. Connolly’s former employer had in fact filed frivolous and groundless litigation against Ms. Connolly. The court, in the attached memorandum of decision, noted that the actions by the former employer were so egregious that it merited treble damages under G.L. c. 93A.
- March 30, 2011 – Siden & Associates, P.C. along with Jones Day of Chicago, IL prevails in copyright infringement case for client Situation Management Systems, Inc. (SMS) in the United States District Court for the District of Massachusetts (Stearns, D.J.). After a 4 day trial that concluded on April 1, 2010, the court awarded SMS $450,000.00 – the maximum allowed by law – in statutory damages under the copyright law (not including attorneys fees) against defendant Lamoco Consulting, LLC (aka ASP.Consulting, LLC). SMS, a New Hampshire company, has marketed and developed corporate training works such as Positive Power & Influence since 1976. SMS trains companies and organizations such as Anheuser-Busch, NASA, Pfizer, General Mills and Procter & Gamble in improving influence, selling and innovation. Two ex-employees of SMS formed a start-up company called ASP. Consulting, LLC (“ASP”) in 2004 along with an ex-SMS sublicensee based in Austria. ASP soon published three corporate training works that appeared substantially similar to three of SMS’s main corporate training works. SMS filed its lawsuit in September 2006. In rendering its decision, the court agreed that ASP’s copying was “blatant” and that the infringement was not only willful but 'predatory'. SMS's victory is a benchmark for those in the corporate training industry who seek to protect their originally created training materials. Read the full decision (PDF).
